Attorney-filed trademarks

Your brand name is not yours until it is registered

A real New York trademark attorney files it for you. $997, or 3 payments of $397. If the USPTO refuses it, I refile it once with no attorney fee.

Licensed in New York · Files in all 50 states · 7 years IP counsel at IBM · Flat fee, no surprises

You already put the name on your product. Now protect it

TM is not R.

Putting TM on your shirts only says you use the name. The R says the government agrees it is yours.

Someone can file first.

If another business files your name before you, you can be forced to rename.

Renaming costs more.

New labels, new site, new ads. A filing now costs far less than a rebrand later.

Three steps. About 10 minutes of your time

  1. 1

Free 10-minute Name Check. I search your name live and tell you: clear, risky, or no.

  2. 2

I file it. I pick the right class and write your goods the right way, then file with the USPTO.

  3. 3

I handle the USPTO until it registers. Letters, deadlines, questions. You get updates. Most marks take 7 to 8 months. That wait is the USPTO's, not ours.

Questions

What is the difference between TM, R and C?

TM means you use the name as a brand. R means it is federally registered. C is copyright, for things like books, art and music.

Can I use my name before it is registered?

Yes. Use it now and put TM next to it. Switch to R once it registers.

How long does it take?

I file within about a week of your intake. The USPTO usually takes 7 to 8 months to register a mark.

Can I protect my logo too?

Yes, as a $397 add-on. I usually file the name first, because the name covers you even if the logo changes.

What if my name is refused?

I refile once with no attorney fee. If a refusal needs a full legal argument, I tell you the options and the price before any work.

Why is there a separate $350 fee?

That is the USPTO's government fee per class. Everyone pays it, even people who file on their own.

Are you a real attorney?

Yes. I am licensed in New York and I handle federal trademark filings for clients in all 50 states. You work with me directly.
